Terms of Service

1. Eligibility

You must be at least 18 years old to use Pars Auto Market. By creating an account, you represent that you are of legal age and have the capacity to enter into binding agreements.

Service area. Pars Auto Market operates in the United States only. Listings, checkout, shipping, seller payouts, and local in-person meetups are all limited to the United States, and prices are shown and charged in US dollars. We do not currently support international buyers, sellers, or shipping.

2. User Accounts

You are responsible for maintaining the confidentiality of your account and password. Pars Auto Market is not liable for any loss or damage arising from your failure to safeguard your login credentials.

Public profile information. The name and profile photo you provide at signup (and later update) are visible to other users across the Platform, including on your listings, offers, chats, and seller profile. By creating an account you acknowledge that this information is public to other Pars users. Your email address and phone number remain private and are never shown on your public profile.

3. Listing Items for Sale

Pars Auto Market is a peer-to-peer marketplace that connects buyers and sellers of auto parts. In some cases, Pars Auto Market may also facilitate the sale and shipment of new parts directly from third-party vendors. While we may assist in order processing and fulfillment, we do not manufacture, own, inspect, or guarantee any products listed by sellers.

By listing an item for sale on Pars Auto Market, you agree that:

• You assume full responsibility for the accuracy, legality, and content of your listings, including all images, descriptions, representations, and item specifications.
• You will not list and will promptly remove any product that has been recalled by a manufacturer or government agency, is prohibited for sale under any applicable law or regulation, or poses a health or safety hazard as identified by any regulatory authority.
• You are solely responsible for understanding and complying with all applicable local, state, and federal laws and regulations, including those related to emissions, safety, and road use restrictions.
• Pars Auto Market has no responsibility or liability for the safety, emissions compliance, regulatory legality, or performance of any item listed or sold through our Platform, including any item subject to recall.
• You are solely responsible for any defect, non-conformity, or failure to comply with emissions, safety, or recall requirements applicable to any product you list or sell using our Platform.
• Pars Auto Market reserves the right to edit, modify, remove, or decline any listing that, in our sole discretion, violates our policies or any applicable law.
• All items must be described truthfully and accurately. Misrepresentation of condition, functionality, or authenticity is strictly prohibited and may result in suspension or termination of your account.

4. Purchasing Items

By purchasing an item on Pars Auto Market, you acknowledge and agree that:

• Pars Auto Market does not guarantee the safety, quality, authenticity, legality, roadworthiness, or emissions compliance of any item listed on the Platform.
• All purchases are made at your own risk, and you are responsible for ensuring that any item you buy complies with applicable local, state, and federal laws, including emissions regulations and road use restrictions.
• Pars Auto Market is not responsible for the installation, use, or regulatory status of any product after it is delivered.
• For information regarding warranties, please refer to our Return and Refund Policy.

Older listings cannot be bought directly. A listing that has been up for more than 30 days can no longer be purchased through checkout. After a month we cannot be confident the item is still available, and we would rather send you to the seller than take your payment for something that may already be gone. Messaging the seller, making an offer, and arranging a local in-person meetup all still work on those listings, and a seller can relist an item to make it buyable again. This limit is a safeguard for buyers and does not create any obligation on Pars Auto Market to keep any listing available for any period of time.

5. Fees

Buyer Fee: None. Pars Auto Market does not charge buyers any platform, service, escrow, or protection fee. A buyer pays the item price, applicable sales tax, and (unless the seller has elected to cover it) shipping. Nothing else is added at checkout.

Seller Fee: Pars Auto Market charges a 6.5% fee to sellers per completed transaction. This fee is deducted from the sale price, excluding tax and shipping costs.

The seller fee helps cover escrow, payment processing, and platform maintenance. Fees are generally non-refundable unless an item is determined by Pars Auto Market to be not as described. In such cases, the buyer must open a support ticket within 48 hours of delivery. Pars Auto Market may request evidence such as photos or videos and will determine at its sole discretion whether to issue a refund or credit.

Orders placed before August 16, 2026 were charged an Escrow & Protection Fee of 4% of the item price (minimum $6.50). That fee has been retired and is no longer charged on any new order.

6. Pars Escrow: How It Works

6.1 What Is Pars Escrow?

Pars Escrow is Pars Auto Market's built-in payment protection service. When a buyer completes a purchase, the full payment (the item price plus any applicable shipping and taxes) is collected by Pars Auto Market through our payment processor (Stripe) and held securely until the transaction is confirmed complete. The seller does not receive any funds during this holding period.

We are fully transparent about this process: Pars Auto Market receives and holds your payment. The funds sit in our Stripe account balance on your behalf and are only released to the seller once the escrow conditions below are satisfied. This protects buyers from receiving items that are not as described, and protects sellers by guaranteeing payment once they ship.

6.2 Step-by-Step Escrow Flow

1. Buyer completes checkout. The full order amount is charged to the buyer's card and received by Pars Auto Market via Stripe. The seller is notified to prepare the item for shipment.
2. Seller ships the item. The seller generates a shipping label through the platform (EasyPost) and ships the item. Tracking information is automatically attached to the order.
3. Item is delivered. When the carrier marks the package as delivered, Pars Auto Market automatically starts a 48-hour buyer inspection window. The buyer receives an email notification.
4. Buyer inspects the item. During the 48-hour window, the buyer can:
   • "Everything Looks Good": The buyer confirms receipt. Escrow is released immediately and the seller's payout becomes eligible.
   • "Report a Problem": A dispute ticket (prefixed DSP-) is created. The seller's payout is paused and our team contacts the buyer within 24 hours to investigate.
   • No action taken: If the buyer does not respond within 48 hours, escrow is automatically released and the seller's payout becomes eligible. This is by design: the window is finite to protect sellers from indefinite holds.
5. Seller requests withdrawal. Once payout is eligible, the seller can navigate to "My Payments" and request a withdrawal to their connected bank account.
6. Admin reviews and releases funds. Pars Auto Market's team reviews the withdrawal request and initiates the bank transfer. Funds typically arrive in the seller's bank account within 1–5 business days after approval (new accounts may experience a one-time hold of up to 7 days by Stripe as a security review).

6.3 Important Notes on Escrow

• Pars Escrow is free for buyers. We do not charge for escrow, dispute coverage, or buyer protection. The cost of operating the escrow service is covered by the seller fee described in Section 5.
• Funds held in escrow are not invested and earn no interest. They are held in our operating account solely for the purpose of completing the transaction.
• In the event of a dispute, Pars Auto Market may hold funds beyond the 48-hour window until a determination is reached. All dispute decisions are final and binding.
• Pars Auto Market is not a bank or licensed escrow company. Our escrow service is a platform feature provided to facilitate transactions between private buyers and sellers.

6a. Dispute Workflow

If a buyer reports a problem during the inspection window:

• A dispute ticket (prefixed DSP-) is automatically created and linked to the order.
• The seller's payout is paused while the dispute is open.
• Our support team will contact the buyer at the email address on file within 24 hours.
• Pars Auto Market may request photos, videos, or other evidence and will make a final determination at its sole discretion.
• Once resolved, payout is released to the appropriate party and the dispute is closed.

All decisions by Pars Auto Market in connection with disputes are final and binding.

7. Returns & Cancellations

• Orders can only be canceled before the seller ships the item. Once tracking shows that an order has shipped, it cannot be canceled.
• If eligible under the Return and Refund Policy, buyers may request a return or refund after the item is delivered.
• To cancel an order or request a return, please email support@parsautomarket.com or submit an inquiry through the Platform with your order number and details of the request.

7a. Local In-Person Meetups

A seller may offer a listing for local in-person meetup instead of, or in addition to, shipping. A meetup is a private transaction between the two people involved. Pars Auto Market is not a party to it.

For any sale completed by meetup:

• Pars Auto Market charges nothing. There is no buyer fee and no seller fee on a meetup, because no payment is processed through the Platform.
• Payment is entirely between buyer and seller. How and whether you pay (cash or anything else) is your decision and your risk. Pars Auto Market does not collect, hold, transmit, or refund meetup payments, and has no record of them.
• There is no escrow and no buyer protection. Pars Escrow, the 48-hour inspection window, the dispute process in Section 6a, and the Return and Refund Policy apply only to orders paid for through the Platform. None of them apply to a meetup.
• We do not vet the other person. Pars Auto Market does not run background checks, verify identity, or inspect any item before a meetup.
• Locations shown are approximate. A listing displays a city and a general map area derived from a ZIP code. Pars Auto Market does not publish any user's street address. Arrange a specific meeting place between yourselves in Chats.
• Your safety is your responsibility. Meet in a busy, well-lit public place during daylight. Many police departments provide a designated safe-exchange zone. Consider bringing someone with you, and do not meet at a private residence.

To the fullest extent permitted by law, Pars Auto Market disclaims all liability for any loss, injury, damage, theft, fraud, misrepresentation, or dispute arising out of a local in-person meetup, including a meetup arranged through Chats. If you want the protection of escrow, complete the purchase through the Platform instead.

8. In-Platform Messaging

Pars Auto Market provides in-platform messaging (Chats) so buyers and sellers can ask questions and negotiate about listings. All communication about a transaction must take place on the Platform so we can enforce our policies and resolve disputes.

When using Chats, you agree that:

• No contact information. You will not share, solicit, or attempt to exchange phone numbers, email addresses, social media handles, external messaging app contacts (WhatsApp, Telegram, Signal, etc.), mailing addresses, or any other personal contact information inside chat messages.
• Keep the conversation on Pars. Arranging a local in-person meetup through Chats is permitted and expected. Agreeing on a public place and a time is ordinary use of the Platform (see Section 7a). What is not permitted is moving the conversation itself off Pars Auto Market, or diverting an order that is being purchased through the Platform to cash, Venmo, Zelle, wire transfer, or any payment method not processed through the Platform.
• No external links. You will not send links to any website other than parsautomarket.com. Links to Pars listings are permitted and are displayed as listing previews in chat. All other links, including link-shortener and lookalike domains, are blocked.
• No impersonation or phishing. You will not impersonate Pars Auto Market, "Pars Support," or any other person or entity, and you will not send messages asking another user to "verify their identity," click a verification link, or provide credentials or personal information. Pars Auto Market will never ask you to verify your identity through a chat message; report any such message to support@parsautomarket.com.
• No harassment. You will keep messages respectful. Threats, hate speech, sexual content, or other abusive behavior is not permitted.
• Automated filtering and moderation. Pars Auto Market uses automated systems to screen chat messages for contact information, external links, off-platform payment arrangements, and scam or phishing language. Messages flagged by these systems are blocked before delivery and are automatically reported to, and may be reviewed by, our trust & safety team. Pars Auto Market may also review chat content to enforce these Terms and investigate reports.

Violations of this section may result in immediate and permanent account termination, loss of access to listings, orders, and any funds in escrow, at Pars Auto Market's sole discretion.

9. Prohibited Conduct

You agree not to:

• Violate any applicable laws or third-party rights.
• Sell illegal, recalled, counterfeit, or unsafe items.
• Use the Platform for deceptive, fraudulent, or misleading purposes.
• Circumvent policies or manipulate transactions.
• Share phone numbers, emails, or external contact info via Chats, or move a conversation off the Platform (see Section 8). Arranging a local meetup in Chats is permitted (see Section 7a).
• Impersonate Pars Auto Market, its support staff, or any other person, or send phishing links or messages designed to obtain another user's credentials, identity documents, or payment information.

10. Account Termination

Pars Auto Market may suspend or terminate accounts at its sole discretion and without prior notice. Common reasons include:

• Abusing the return/refund system.
• Attempting fraud or scams.
• Repeated listing of banned or misrepresented items.
• Disputing valid transactions in bad faith.

Termination may result in loss of account access, listings, and funds in escrow.

11. Dispute Resolution

Pars Auto Market may assist in resolving disputes between users. All decisions we make in connection with such disputes are final and binding.

12. Limitation of Liability

Pars Auto Market is not liable for:

• Any direct, indirect, incidental, or consequential damages.
• Disputes or issues arising from user-to-user transactions.
• Loss, theft, or damage during shipping.
• Noncompliance with any applicable vehicle, emissions, or safety regulations.

All use of the Platform and participation in transactions is at your own risk.

13. Intellectual Property

The Platform, including its design, logos, text, graphics, software, and all related content (excluding user-generated listings), is owned by Pars Auto Market LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

By posting a listing, you grant Pars Auto Market a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute the content of your listing (including photos and descriptions) for the purpose of operating and promoting the Platform. You represent that you own or have the rights to all content you post.

14. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, PARS AUTO MARKET DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY ITEM LISTED WILL MEET YOUR EXPECTATIONS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Pars Auto Market LLC, its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Platform; (b) items you list, sell, or purchase; (c) your violation of these Terms or any applicable law; or (d) your violation of any third-party right, including intellectual property rights.

16. Governing Law & Venue

These Terms and any dispute arising out of or relating to them or the Platform are governed by the laws of the State of California, without regard to its conflict-of-law principles. Subject to Section 11, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from bringing an eligible claim in small-claims court.

17. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.
